{¶ 9} I respectfully dissent. Based on my concurrence in State v.Miller, 9th Dist. No. 06CA0046-M, 2007-Ohio-1353, and my dissent inState v. Goodwin, 9th Dist. No. 23337, 2007-Ohio-2343, I would find the trial court's judgment to be a final, appealable order. Accordingly, I would address the appeal on its merits.
