{¶ 43} I concur with the majority as to appellants' second and third assignments of error. I, however, dissent with the majority's decision as to appellants' first assignment of error. I would find that the trial court's denial of the Bureau's motion to dismiss is not a final, appealable order. Polikoff v. Adam (1993), 67 Ohio St.3d 100, 103, 616 N.E.2d 213. ("Generally, an order denying a motion to dismiss is not a final order.")
