August 15, 2005, reported at 419 F.3d 195, be amended as follows:
On page 206, footnote 11, delete the text of the footnote and insert in its
place the following: “The actual term was not used in a reported case until 1975. See
James Talcott, Inc. v. Wharton (In re Continental Vending Machine Corp., 517 F.2d 997,
1004 n.3 (2d Cir. 1975).”
On page 207, in the tenth line of the left-hand column, replace “Talcott”
with “James Talcott, Inc.”
