    Wilbur ALLEN, Petitioner-Appellant,
    v.
    E.B. WRIGHT, Warden, Respondent-Appellee.

    No. 86-6738.

United States Court of Appeals, Fourth Circuit.

    Submitted Dec. 30, 1986.
    Decided Feb. 10, 1987.

Appeal from the United States District Court for the Eastern District of Virginia, at Richmond. David G. Lowe, United States Magistrate. (C/A No. 85-868-R)

    Wilbur Allen, appellant pro se.

Robert B. Condon, Assistant Attorney General, Jacqueline G. Epps, Assistant Attorney General, for Appellees.

    E.D.Va.

    DISMISSED.

Before WIDENER, HALL and SPROUSE, Circuit Judges.

    PER CURIAM:

    1

A review of the record and the magistrate's opinion discloses that an appeal from the order refusing habeas corpus relief pursuant to 28 U.S.C. Sec. 2254 would be without merit. Because the dispositive issues recently have been decided authoritatively, we deny a certificate of probable cause to appeal, dispense with oral argument, and dismiss the appeal on the reasoning of the magistrate. Allen v. Wright, C/A No. 85-868-R (E.D.Va., Aug. 19, 1986).

    2

    DISMISSED.
