I concur in the reasoning and conclusion of Justice Olney. The interpretation of section 3, article XI, is in accordance with a long line of decisions interpreting the permissive clause of section 5, article XI. (Dwyer v. Parker, 115 Cal. 544, [47 P. 372]; Knight v. Martin, 128 Cal. 247, [60 P. 849].)
