  • From the form of the pleadings and the delay in making the application, it having been made on the very eve of the trial, we are led to the conclusion that it should be denied for want of good faith. Order denying motion to vacate the order for appellant’s examination reversed, with ten dollars costs and disbursements, and motion to vacate the said order granted, with ten dollars costs. Jenks, P. J., Rich, Putnam, Blaekmar and Jaycox, JJ., concurred.
