dissenting. The brief of evidence in this case is the same as that in the case of National Ben Franklin Fire Insurance Company v. Hurley, ante, 815. The policy sued on in this case was in the name of John Hurley solely. For the reasons given in my opinion in the other case I am of the opinion that under the law and the evidence a verdict for the plaintiff: was demanded, and the court erred in directing a verdict for the defendant.
