    Jeffrey S. CERKONEY, Plaintiff--Appellant,
    v.
James A. SMITH; James Carter; Gordon K. Lavin; Lew
    Robertson, Defendants--Appellees.

    No. 95-6905.

United States Court of Appeals, Fourth Circuit.

    Submitted Aug. 8, 1995.
    Decided Aug. 25, 1995.

Jeffrey S. Cerkoney, Appellant Pro Se. Jane Ray Garvey, OFFICE OF THE ATTORNEY GENERAL OF NORTH CAROLINA, Raleigh, NC, for Appellees.

    E.D.N.C.

    AFFIRMED.

Before NIEMEYER, HAMILTON, and WILLIAMS, Circuit Judges.

    PER CURIAM:

    1

Appellant appeals from the district court's order denying relief on his 42 U.S.C. Sec. 1983 (1988) complaint. We have reviewed the record and the district court's opinion and find no reversible error. Accordingly, we affirm on the reasoning of the district court. Cerkoney v. Smith, No. CA-94-210-5-F (E.D.N.C. May 25, 1995). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process.

    2

    AFFIRMED.
