IN error on certiorari, Oftrander fubmitted that the judgment obtained again!! the now plaintiff, by the prefent defendants, ought to be reverfed. ill. Becaufe the wife was joined in the afiion below, which was afiumpfit, without íhew-ing how Ihe had any intereft. 2nd. Becaufe it appeared from the record, that a perfon not a confiable was fworn to attend the jury, and for thefe reafons the judgment was accord-ir.gly reverfed.
