In an action to recover damages for personal injuries, plaintiff appeals from a judgment of the Supreme Court, Kings County, entered April 21, 1959, after a non jury trial, which dismissed the complaint on the merits as against defendant Kearney. Judgment affirmed, with costs. No opinion. Beldock, P. J., Ughetta, Kleinfcld, Hill and Rabin, JJ., concur.
