DISSENT

I join in the dissent of Justice Page in part. When Coats’ attorney appeared at the October 12, 1999, pretrial hearing, I agree that Coats was present by her counsel’s representation and the district court erred in permitting her counsel to withdraw and then finding Coats in default; the court erred in failing to vacate the judgment of default. I would therefore affirm the court of appeals.
