NEWMAN, J., specially concurring.
I concur in the court’s opinion, except for the last sentence of note 2.1 agree that State v. Bridewell, 306 Or 231, 759 P2d 1054 (1988), binds us, but I do not join in the implication that it was incorrectly decided.
