  • There is no possible analogy between the law dealing with food fish within its waters, which is the absolute property of the state as held in Vail v. Seaborg, 120 Wn. 126, 207 P. 15, and the law exercising control and police power over intoxicating liquor within this state. However, the result of the decision herein is right, and I concur in the result.
