I concur in the majority's analysis and disposition of appellants' first and third assignments of error. Although I disagree with the majority's analysis of appellants' second assignment of error for the reasons expressed in my dissent in Vickers v. Howe (1998),123 Ohio App.3d 456, I nevertheless must concur in its disposition thereof on the basis of stare decisis.
