{¶ 29} I would affirm the trial court's decision. The alleged failure to hire may be used to assist in establishing a discrete discriminatory act of age discrimination at the time of the termination of Appellant's employment; it does not state with particularity an independent discriminatory act as required in Morgan, 536 U.S. at 122.
